Data Protection Commission Says Enforcement Begins in 2026

The Data Protection Commission (DPC) has announced plans to enforce the Data Protection Act 2012, Act 843, beginning January 2026.

This will be preceded by a regularisation of processing activities, it said in a statement.

“The Data Protection Commission (DPC) announces for the attention of all data controllers that 31° December 2025 is the deadline for regularising processing activities with the Data Protection Act 2012, Act 843.”

It urged all public and private entities to comply with the provisions of the Act, adding that the Commission will crack down on Institutions operating outside of the law from 2026.

The enforcement teams will inspect organisations that process personal data without registering with the Commission (Section 53); Hold expired Data Protection Certificates (Section 50); Have incomplete registration but continue processing data (Section 53); and have not implemented data governance and security measures (Section 28).

“All institutions are encouraged to take advantage of the ongoing Privacy Awareness Campaign to regularise their status with the Commission to avoid shutdowns.”
