Presidency Replies Afenyo-Markin Over “Constitutionality” of BoG Governor’s Office Assumption

Felix Kwakye Ofosu, the acting Spokesperson of President John Dramani Mahama says former President Nana Addo Dankwa Akufo-Addo employed the same procedure adopted to appoint Dr. Johnson Asiamah as the Governor of the Bank of Ghana.
Kwakye Ofosu in a Facebook post, put up the 2017 statement that was issued by the Presidency to announce Dr Ernest Addison’s assumption of office while the Council of State was yet to be constituted for his approval or otherwise.
He captioned it: “The Minority Leader complains about Dr. Johnson Asiama’s appointment as BoG Governor pending consultations with the yet-to-be-formed Council of State.
“Here is the same procedure used to appoint the Common Fund Administrator by Prez Akufo-Addo in 2017. What sayeth him about this?”
Constitutionality
Following the assumption of Office by the appointee on February 3, 2025, the Minority Leader, Hon Alexander Afenyo-Markin wrote to the President questioning the constitutionality of the move.
According to him the fact that he assumes office while the appointment is pending approval by the Council of State raises serious procedural and constitutional concerns.
“It is worth considering the precedent this sets. If, for instance, a judicial nominee were to take their seat in court and begin administering justice before receiving the necessary approvals from the Judicial Council, it would be widely deemed inappropriate. The same principle must apply in this instance.”
He raised concerns about the next course of action if his appointment is rejected by the Council.
The Effutu MP therefore opined that Dr. Asiamah refrains from engaging in official duties at the Bank of Ghana until his nomination has been duly approved by the Council of State.
