PPA Issues Final Warning to Procurement Entities Over GHANEPS Non-Compliance

The Public Procurement Authority (PPA) has issued a final caution to all Procurement Entities failing to comply with the Public Procurement Act, 2003 (Act 663) as amended, warning that it will publish the names of defaulters and invoke sanctions.
In a public notice, the PPA said its review of the Ghana Electronic Procurement System (GHANEPS) online platform shows some entities have not met mandatory requirements under Sections 21 and 31 of the Act.
“PLEASE BE NOTIFIED that this publication is a FINAL CAUTION to all Procurement Entities that are in breach of these provisions,” the PPA stated.
The Authority said it will proceed to publish the names of defaulting entities after this caution and apply sanctions as required by law.
It warned that the PPA Board will decline to consider any applications for single source or restricted tendering submitted by non-compliant entities.
The PPA reminded Heads of Procurement Entities that Section 18 of Act 663 places direct responsibility on them to ensure compliance.
“The PPA, therefore, expects Heads of Procurement Entities to ensure strict compliance with the provisions of the Act as amended,” the notice added.
Section 21 mandates Procurement Entities to publish their procurement plans on GHANEPS and update them quarterly, while Section 31 imposes a duty to promptly publish all contract awards on the same platform to ensure transparency and accountability.
