Minority Demands Withdrawal of Kpandai Seat Vacancy Declaration

The Minority in Parliament has kicked against the declaration of the Kpandai seat as vacant, calling for its immediate withdrawal.

In a statement on the floor of Parliament, Minority Chief Whip Frank Annoh-Dompreh condemned the action as ultra vires.

“Mr Speaker, there is a letter that was sent into the house to declare the Kpandai seat vacant. That letter is out of place, unfortunate, and goes against the rule of law. We strongly submit that the letter must be withdrawn by Parliament. We in the minority will not agree to the writing of this letter,” he said.

In a letter dated December 8, 2025, the Clerk to Parliament wrote to the Electoral Commission declaring the seat vacant.

The move was to make way for the conduct of a fresh election in accordance with a Tamale High Court ruling delivered last month.

The National Democratic Congress (NDC) candidate for the area, Daniel Nsala Wakpal, filed a petition claiming the December 7, 2024, election was marred by serious irregularities.

He pointed out inconsistencies in Form 8A (the “pink sheet”) from 41 out of 152 polling stations, citing breaches of Regulations 39 and 43 of the Public Elections Regulations (CI 127).

The court ruled that these irregularities compromised the election’s integrity and ordered the Electoral Commission (EC) to conduct a rerun of the parliamentary election in the entire constituency within 30 days.

Meanwhile, the New Patriotic Party candidate (NPP), Matthew Nyindam, who until the ruling occupied the seat, has filed an appeal against the Court ruling.
