Ebo Noah Case Could Also Fall Under Cybersecurity Act – Lawyer Explains
Legal practitioner, Nicholas Osei Darkwa, says the recent arrest of Ebo Noah could have also been pursued under Ghana’s Cybersecurity Act, 2020, in addition to existing criminal laws, due to the distress his actions caused the public.
Lawyer Osei Darkwa made the remarks on Nkwantannanso on Opemsuo FM.
According to the lawyer, Ebo Noah’s actions primarily fall under the Criminal Offences Act, Act 29, particularly the publication of false information. However, he noted that the Cybersecurity Act also provides a legal basis for prosecution.
“His actions fall under the Criminal Offences Act, especially the publication of false information, but he could also have been charged under the Cybersecurity Act because his actions caused distress,” he explained.
The lawyer noted that religion in Ghana is a highly sensitive issue and that false or misleading information linked to faith can easily affect people emotionally and financially.
The lawyer urged the public to be cautious about what they publish or share online, especially on sensitive issues.
“Beyond the legal framework, we must also rely on our conscience,” he advised.
Lawyer Osei Darkwa further explained that earlier laws did not anticipate the scale and impact of social media, which made it necessary for the state to introduce laws such as the Electronic Communications Act and the Cybersecurity Act.
