9 Seek Interlocutory Injunction Against Deactivation Of Unregistered SIM Cards
Nine Ghanaian citizens have jointly applied for an interlocutory injunction from the Supreme Court of Ghana against the institution of any form of punishment against persons who have not re-registered their SIM cards.
This comes ahead of the deadline set by the Minister for Communication and Digitalisation, Ursula Owusu Ekuful, for the re-registration exercise on September 30, 2022.
The applicants have dragged the Attorney-General Ministries and the National Communications Authority (NCA) to court in the matter of an application under Articles 23, 141 and 296 of the 1992 Constitution; in the matter of the National Communications Act, 2008 (ACT 769); In the matter of Subscriber Identity Module Registration Regulation Module, 2011 (L.I. 2006) and National Identity Register Regulation 2011 (L.I. 2111); and in the matter of an application for judicial review of the mobile sim card reregistration directives, imposition of punitive measures or sanctions and the intended barring of telecommunication service by the respondents.
The applicants want the respondents restrained from implementing the sanctions that follow the deadline until a determination by the Court.
