Supreme Court Suspends Kpandai 2024 Parliamentary Election Rerun

The Supreme Court has ordered the Electoral Commission to suspend all arrangements for the rerun of the parliamentary election in Kpandai pending the determination of an application challenging the High Court’s judgement that ordered the rerun.

In an order this morning, a five-member panel of the Supreme Court, with Justice Gabriel Pwamang presiding, stated that this would ensure the election did not overreach the court in its determination of a certiorari application filed by the New Patriotic Party’s (NPP) Mathew Nyindam.

Per the orders of the court, the processes are to be posted on the house address of Mr Wakpal, the notice boards of the Tamale High Court, the District Court in Kpandai and Mr Wakpal’s personal WhatsApp contact.

According to the bench, the notices are to remain for seven days and would be deemed to have been served after the period.

The case has been adjourned to January 13, 2026.

Substituted Service
The order came after Lawyers for the New Patriotic Party’s (NPP) Mathew Nyindam, led by Gary Nimako Marfo moved a motion for substituted service to enable them to properly bring the application for certiorari to the attention of the 2024 National Democratic Congress (NDC) parliamentary candidate for Kpandai, Daniel Nsala Wakpal.

Absence
When the case was called today (Dec 16), the bench was not happy and expressed displeasure about the absence of representatives from the office of the Electoral Commission.

Mr Wakpal was also absent since the motion for substituted service was filed ex-parte.

The President of the five-member panel, Justice Gabriel Pwamang, asked Justin Amenuvor why officers of the EC were absent.

“They don’t consider the actions serious enough? And they are running our election, and they will not come to the Supreme Court,” Justice Tanko Amadu, who was also not happy about the absence of the EC, said.

Moving the motion for an order of substituted service, counsel for the applicant, Gary Nimako Marfo, said since the judgment was given at the High Court, bailiffs had not been able to serve the motion filed at the Supreme Court on Mr Wakpal.

The bench asked lawyer for the EC, Justin Amenuvor, whether the commission had contact details of Wakpal when he filed to contest the 2024 elections.

But counsel said that unless he verifies that information from the EC.

“Unfortunately, you see what the commission has put you and the court into? The gentleman who signed the press statement for the rerun should have been here,

Because he would have come with some institutional memory of the candidate and particulars,” Justice Tanko said.

Mr Nimako drew the attention of the court to the contact details of Mr Wakpal on the petition he filed at the High Court.

He then proceeded to send mobile money to the contact of Mr Wakpal to confirm the name.

Background
The High Court in Tamale in November 2025 annulled the 2024 parliamentary election results for the Kpandai Constituency and ordered a rerun of the entire election.

Prior to that, the seat was being occupied by Mr Matthew Nyindam.

In the judgment, the court, presided over by Justice Emmanuel Brew Plange, held that the election was flawed with widespread irregularities and, therefore, ordered a rerun of the election within 30 days.

The judgment followed a petition filed by Wakpal challenging the election.

After the judgment, the EC announced December 30, 2025 to run the elections.
