Court Prioritizes Charles Bissue’s Discovery Motion, Postpones Injunction
The High Court in Accra, presiding over the case brought by Charles Bissue to prevent the Office of the Special Prosecutor (OSP) from prosecuting him, has deferred the hearing of an injunction application filed by Bissue. Instead, the court has decided to give priority to Bissue’s application for discoveries.
The motion for discovery is not yet scheduled for a hearing, as Bissue claims that he has not received the OSP’s affidavit in opposition.
Despite the OSP’s objections, the court ruled today that it will not proceed with the injunction application until after Bissue has moved his motion for discovery on June 12, 2023.
The judge emphasized that the plaintiff, Bissue, has the discretion to determine the order in which the motions should be addressed.
Providing some background to the case, Charles Bissue initiated legal proceedings by filing a Writ of Summons and Statement of Claim against the OSP and two others in December 2022.
This followed the OSP’s announcement in its Half Yearly Report that it had completed investigations into corruption allegations against Bissue raised by Tiger Eye P.I. and Anas.
In January 2023, Bissue amended the writ, and subsequently, he filed an injunction seeking to restrain the OSP from further investigating and prosecuting him.
The OSP was granted permission to file its statement of case in opposition to the motion. However, Bissue has not yet pursued the injunction application, leading to several adjournments.
In the meantime, Bissue has filed a motion to disclose the petition filed by Anas against him, which has been met with opposition from the OSP.
