Supreme Court Ruling on Domelevo’s Leave Holds No Significance – Lawyer Amaliba
Private legal Practitioner and member of the National Democratic Congress (NDC) legal team, Mr. Abraham Amaliba, has criticised the recent Supreme Court ruling on former Auditor-General Daniel Domelevo’s Leave. According to him, the ruling holds no essence and only carries futuristic significance.
“What is the essence of this ruling since the former Auditor General is on retirement? It is only significant for future presidents.”
In an interview with George Agyei on Nkwantannanso on May 31, he expressed disappointment in the Supreme Court for not considering the time sensitivity of the case. He believes that the court should have acted swiftly, given the urgency of the matter at hand.
When asked about the possibility of compensation for Mr. Domelevo, he clarified that while it would have been possible if Mr. Domelevo himself had filed the case, since it was brought by civil society organisations, no compensation can be granted.
In a unanimous decision, the Supreme Court of Ghana, today declared President Nana Addo Dankwa Akufo-Addo’s directive for former Auditor-General Daniel Domelevo to proceed on leave as unconstitutional.
The court further ruled that the President acted unconstitutionally by appointing an acting Auditor General while Mr Domelevo was still in office.
The court’s decision, announced on May 31, 2023, was declaratory in nature and did not issue any consequential orders since Mr Domelevo had already retired from office.
