Private Citizen Sues Over Establishment of OSP

A private citizen has initiated a legal action against the establishment of the Office of the Special Prosecutor (OSP).
This was confirmed by the Deputy Attorney-general, Justice Srem Sai in a Facebook post on Wednesday, December 10, 2025.
“I can confirm that a citizen – Noah E. Tetteh- has sued the Attorney-General in Supreme Court suit number J1/3/2026.”
According to plaintiff, Parliament has no power to set up an office of a prosecutor which is independent and outside the control of the Attorney-General.
He is seeking an order to strike down … the provisions of Act 959 that confer autonomous prosecutorial authority on the Office of the Special Prosecutor or insulate it from the Attorney-General’s constitutional control.
It comes as the Office has come under criticism from a section of Ghanaian seeking its scrapping.
They argue that the Office overlaps its mandates and is a duplicate of the Attorney-General’s Department.
Majority Leader in Parliament, Mahama Ayariga and Majority Chief Whip, Rockson-Nelson Dafeamekpor has pursued this further by submiting a Private Members’ Bill to repeal the Office of the Special Prosecutor Act, 2017 (Act 959).
The proposed legislation aims to restore sole prosecutorial authority over corruption-related offences to the Attorney-General, as stipulated under Article 88 of the Constitution.
