Facts
According to the facts as presented by Prosecutor G/L/Cpl. Peter Oduro, the complainant, Derrick Arthur, is a gold buyer at Adansi Nkrankese, while Eric Afful is his friend and okada rider.
On September 3, 2026, at about 6:10 p.m., Eric Afful met Abdul Ganiu and David Mensah at Mensah’s house at Kojo Mankrong and told them he owed Ben an amount of GH¢2,000, which he needed to repay to retrieve his seized motorbike.
He then sought their help to steal money from the complainant, whom he usually conveys to transact his gold business and Abdul Ganiu and David Mensah consented.
At about 8:00 p.m. the same day, the complainant called Eric Afful to pick him from Nkrankese to Ataase Nkwanta for a MoMo transaction. Afful quickly informed Abdul Ganiu and David Mensah, conveyed them to a cocoa farm along the Akwaaku road, and hid them there.
While carrying the complainant, Afful deliberately slowed down and veered into the hideout, where Abdul Ganiu attacked the complainant with a cassava stick and forcibly snatched his backpack containing a digital mining scale valued at GH¢1,500, melting gas valued at GH¢800, two pounds of gold valued at GH¢22,000 and cash of GH¢10,000.
When the complainant attempted to pursue Abdul Ganiu, David Mensah pulled a cutlass on him and took his iPhone 12 mini, valued at GH¢2,500.
Abdul Ganiu and David Mensah later sent the booty to Mensah’s house where they spent the night. The complainant reported the incident at the Police barrier at Kojo Mankrong.
On September 4, 2026, Eric Afful went to Mensah’s house where the three shared GH¢6,000 from the complainant’s backpack.
Police arrested David Mensah at Apagya, who confessed and led officers to arrest Eric Afful at Obonsu and Abdul Ganiu at Asonkore.
A search of them retrieved GH¢2,000 from Eric Afful, GH¢2,000 from Abdul Ganiu, and the iPhone 12 mini and GH¢2,705 from David Mensah.
The backpack was also retrieved from the cocoa farm, but the two pounds of gold were missing.
